A Thirty (30) Day Notice to Vacate for section 8 tenants is the form used in order to evict a Tenant WITHOUT A LEASE in order to get the Landlord’s property back. Under Florida law, the notice cannot expire in the middle of a rental period. Therefore, the notice will expire the day before the next rental period begins (i.e., if rent is due on the 1st the notice will expire on the 31st).
In order to fill out the form you will need the following information: Landlord’s name, address, and phone number, Tenant’s name, address of the rental property, and the day the rent is due. Please note that if you truly want the Tenant out of the property you cannot accept rent once the thirty day notice has been posted. For all notices given to section 8 tenants the Landlord must send a letter and a copy of the notice to the local public housing authority advising them of the situation (please review your contract to locate this information).
