A Thirty (30) Day Notice to Cure or Vacate for section 8 tenants is the form used in order to evict a Tenant based on non-rent related issues. Non-rent related issues are things like late fees, unpaid utility bills, criminal acts within the property, unauthorized animals, or unauthorized residents. Under Florida law, the thirty day notice referenced herein allows the Tenant 30 days to cure any of the previously mentioned violations unless they are incurable (call us if you aren’t sure whether your Tenant’s violations are curable or incurable). Moreover, if the Tenant does cure the violation
they must not violate again for a period of twelve months or they are subject to eviction.
In order to fill out the form you will need the following information: Landlord’s name, address, phone number, Tenant’s name, address of the rental property, and the specific non-rent related issues. For all notices given to section 8 tenants the Landlord must send a letter and a copy of the notice to the local public housing authority advising them of the situation (please review your contract to locate this information).
